Applicability
All our services are subject to the Dutch Forwarding Conditions (FENEX, latest version), filed with the District Court of Rotterdam. These general terms supplement them; in case of conflict the FENEX conditions prevail. Purchasing conditions of the customer are expressly rejected.
Our services
FCL Forwarding arranges, as a freight forwarder, the ocean carriage of full container loads (FCL) and the related services: pre- and on-carriage, customs formalities, documentation and, on request, cargo insurance. We do not carry goods ourselves; we contract carriers, hauliers and other service providers on behalf of the customer.
Quotations and prices
Quotations are valid until the date stated (14 days by default) and subject to vessel space and equipment availability. Prices are in euro, excluding VAT and excluding import duties, import VAT, demurrage, detention, waiting time, inspections and any other cost not listed in the quotation. Carrier surcharges (such as bunker and ETS surcharges) are passed on as applicable at the time of shipment.
Bookings and confirmation
A booking is concluded upon our written confirmation, including a confirmation sent by one of our AI agents. The customer checks the confirmation immediately and reports inaccuracies within 24 hours. Changes after the carrier's cut-off times may incur costs or may no longer be possible.
Customer obligations
The customer is responsible for correct and complete cargo information: description, HS codes, weights (including the verified gross mass, VGM), value, packaging and, for dangerous goods, the full classification and the required documents. The customer provides shipping instructions and customs documents in time and ensures proper stuffing and securing of the container.
Payment
Invoices are paid within the term stated on the invoice, without discount or set-off. Late payment attracts statutory commercial interest and collection costs. We may retain shipments and documents until all amounts due have been paid (lien under the FENEX conditions).
Liability and insurance
Our liability is limited in accordance with the FENEX conditions and mandatory transport law. Carriers also limit their liability, usually to an amount per kilo or per package far below the actual value of the goods. We therefore recommend cargo insurance, which we arrange for the customer on request.
Damage, loss and delay
Visible damage or loss is noted on the delivery document at delivery and reported to us in writing within the time limits of the FENEX conditions and the applicable transport law. Vessel delays are beyond our control; arrival dates are estimates, not guarantees.
Cancellation
A booking can be cancelled free of charge until it has been confirmed with the carrier. After that, the costs charged by the carrier and other service providers are passed on, plus our administration fee.
Force majeure
In case of force majeure (including strikes, port congestion, weather, government measures, sanctions, disruption of shipping routes and failure of IT or AI systems) our obligations are suspended for as long as the situation lasts, without any right to compensation.
AI agents
Our services are largely performed by AI agents under the supervision of the human management. They always identify themselves as AI. Prices come from our rate table, not from a language model. Governing law and disputes
All agreements are governed by Dutch law. Disputes are settled in accordance with the dispute resolution clause of the FENEX conditions or by the competent court in Rotterdam.
